ALTERNATIVE DISPUTE RESOLUTION

ARBITRATION

Arbitration is a cost-effective method for resolving disputes, allowing the parties to control the process rather than follow the standard rules of procedure. The parties choose the judge who will decide the dispute; the procedure to be followed in resolving the dispute; the costs to be incurred; the time within which the dispute is to be finally resolved; and the involvement, if any, of the public court system.

MEDIATION

Mediation is a consensus-driven means for resolving disputes prior to the filing of a lawsuit or at any point throughout the litigation process. Put simply, the parties come together to reach a mutual agreement. Rather than place their case in the hands of a judge, jury, or arbitrator, the parties themselves devise their own solutions to resolve their dispute. The parties choose a neutral mediator, who helps everyone weigh realistic options and tradeoffs. If the dispute cannot be resolved at mediation, then the parties proceed along the traditional litigation path in the court system.
